1.About these terms
These Terms of Service (“Terms”) are an agreement between you and Akash Sharma, a sole proprietor operating PublishKaro from 22E2, Jagatpura, Jaipur, Rajasthan 302033, India (“PublishKaro”, “we”, “us”). They apply to the PublishKaro website and app at publishkaro.com (the “Service”) and, together with any written proposal we agree with you, to our Meta Ads and Google Ads management services.
By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
2.Eligibility
You must be at least 18 years old and able to enter a binding contract under the Indian Contract Act, 1872. If you use the Service for a business or another person, you confirm that you are authorised to accept these Terms for them.
3.Your account
- Give accurate sign-up details and keep them up to date.
- Keep your password confidential. You are responsible for activity under your account.
- Tell us at once at publishkaro@gmail.com if you suspect unauthorised use.
- One person may not share an account login with others outside their team or workspace.
4.What the Service does
PublishKaro reads the content plan in the Google Sheets you connect, fetches the media linked from it, drafts captions with AI, runs a strict spelling check, and publishes or schedules the posts you approve to Instagram, Facebook, LinkedIn and YouTube through their official APIs. It then writes each post’s status back to your Sheet. Features may change as we improve the Service or as the platforms change their APIs.
5.Third-party platforms
The Service works with platforms run by other companies, including Meta (Instagram and Facebook), Google (Google Sheets, Google Drive and YouTube) and LinkedIn. When you connect an account you must also follow that platform’s terms, community guidelines and policies, such as the Meta Terms and Platform Policies, the LinkedIn User Agreement and Google’s terms of service.
YouTube: if you connect a YouTube channel, you agree to be bound by the YouTube Terms of Service, and the Google Privacy Policy applies to Google’s handling of your data.
We are not responsible for the platforms’ own actions, including rejected or removed posts, rate limits, API changes, outages, account restrictions or changes to reach. A platform can stop or limit our access at any time, which may affect features.
6.Your content and responsibility
You keep ownership of everything you plan, upload or publish (“Your Content”). You give us a limited, non-exclusive licence to host, copy, process and transmit Your Content only as needed to run the Service for you, including sending it to the platforms and AI providers described in our Privacy Policy.
You are responsible for Your Content and for what is published from your accounts. You confirm that you have the rights and permissions it needs (including for music, images, trademarks and people shown), and that it follows the law and each platform’s policies.
7.Acceptable use
You must not use the Service to:
- publish content that is unlawful, defamatory, obscene, hateful, harassing, misleading or infringes anyone’s rights, or that is prohibited under the IT Act, 2000 and the rules made under it;
- send spam, run deceptive or coordinated inauthentic activity, or break a platform’s rules;
- upload malware, probe or attack our systems, or bypass rate limits, security or access controls;
- scrape, copy, resell or reverse engineer the Service, except where the law allows; or
- access accounts, Sheets or Pages you are not authorised to manage.
8.AI captions and spell-check
AI-generated captions and the spelling check are provided “as is”. They can be inaccurate, incomplete or unsuitable, and the spelling check can miss mistakes or flag correct words. You must review captions, titles and on-screen text before you publish or schedule a post.You are responsible for the final content that goes live.
9.Publishing and scheduling
We design the Service to publish each post once and to check with the platform before any retry, but we cannot guarantee that every post publishes at the exact scheduled time or at all, because platforms can delay, reject or change posts. Please check important posts after they are due.
10.Fees
The Service is currently offered free of charge. If we introduce paid plans, we will show the prices and billing terms before you are charged, and nothing will be charged without your agreement. Our ads management services are paid as set out in the proposal we agree with you. Prices exclude applicable taxes such as GST unless stated. Refunds and cancellations are covered by our Refund & Cancellation Policy.
11.Ads management services
When you engage us to manage Meta Ads or Google Ads, the scope, fees and duration are set out in our written proposal or email agreement. Ad spend is paid by you directly to Meta or Google under their advertising terms. We will work with reasonable skill and care, but advertising results such as reach, leads, sales or return on ad spend are not guaranteed.
12.Our intellectual property
The Service, its software, design, logos and the PublishKaro name belong to us or our licensors. These Terms give you a personal, non-transferable right to use the Service; they do not transfer any ownership. If you send us feedback, we may use it without obligation to you.
13.Availability and changes
We work to keep the Service available but do not promise uninterrupted or error-free operation. We may carry out maintenance, and we may change or discontinue features; where a change significantly affects you, we will try to give reasonable notice.
14.Suspension and termination
You can stop using the Service at any time and ask us to delete your data as described in our Data Deletion Instructions. We may suspend or close an account that breaks these Terms, creates risk or legal exposure for us or others, or where the law requires it. Where reasonable, we will tell you why and give you a chance to fix the issue. Sections that by their nature should survive termination (such as ownership, disclaimers, limitation of liability, indemnity and governing law) continue to apply.
15.Disclaimers
To the extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. See also our Disclaimer.
16.Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data, reach or goodwill. Our total liability for all claims relating to the Service in any 12-month period is limited to the amount you paid us for the Service in the three months before the claim, or ₹1,000 if you have paid nothing. Nothing in these Terms limits liability that cannot be limited under Indian law.
17.Indemnity
You agree to indemnify us against claims, losses and reasonable costs (including legal fees) arising from Your Content, your use of the Service in breach of these Terms, or your breach of a third-party platform’s terms or of the law.
18.Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to any right you have under consumer protection law, the courts at Jaipur, Rajasthan have exclusive jurisdiction over any dispute arising from them or from the Service. We encourage you to contact us first so we can try to resolve the issue informally.
19.Changes to these terms
We may update these Terms. We will change the “Last updated” date and, for significant changes, notify you by email or in the app before they take effect. Continuing to use the Service after that means you accept the updated Terms.
